Is kava legal in Australia? In most of Australia, legal pathways exist — but kava is not unrestricted. Different rules apply to personal travel, commercial food imports, food products and therapeutic goods, while the Northern Territory remains a special case.

The four pathways
What Determines Whether Kava Is Legal?
The answer depends principally on how the kava enters Australia, what form it takes, how it is supplied and where it is going.
Commercial Food Import
Commercial food-use imports require an Office of Drug Control permit and must satisfy additional business, transport, biosecurity and food conditions.
Food Standards
Australian food rules restrict permitted kava products, require Noble varieties and prescribe warning statements.
Northern Territory
The federal traveller exemption does not apply in the Northern Territory, where separate kava legislation remains in force.
Plain-English answer
Kava is not simply “banned in Australia”, nor is it unrestricted. Australia has defined legal pathways. The correct pathway depends on whether you are travelling with kava, importing it commercially, selling it as food, dealing with a therapeutic product or taking it into the Northern Territory.
Personal accompanied baggage
Bringing Kava Into Australia for Personal Use
The Office of Drug Control currently provides a specific exemption for qualifying incoming passengers. It is much narrower than a general permission to import kava however you choose.
Passenger Must Be 18 or Older
The federal personal-use exemption applies to an incoming passenger aged 18 years or over.
Up to Four Kilograms
The current exemption permits up to 4 kg of kava powder in the qualifying passenger's accompanied baggage.
Accompanied Baggage
This exemption is specifically an accompanied-passenger pathway. It should not be treated as a general postal, courier or commercial import permission.
The Northern Territory Is Excluded
The Office of Drug Control explicitly states that the personal-use exemption does not apply in the Northern Territory. Do not assume that kava which can lawfully be carried into another part of Australia can then be taken into the NT.
Commercial food pathway
Importing Kava Into Australia for Commercial Food Use
Commercial importation is not an extension of the traveller exemption. It is a separately regulated pathway under Regulation 5F of the Customs (Prohibited Imports) Regulations 1956.

What Kava Can Be Sold as Food?
Import permission and permission to sell a food are different questions. Food kava must also fit Australia's Food Standards Code.
Standard 2.6.3 — Kava
Australia's food-standard framework restricts permitted kava root to specified Noble varieties.
The permitted food pathway covers dried or raw kava root and a beverage produced by aqueous suspension of kava root using cold water.
- The permitted kava root must be from a recognised Noble variety.
- Relevant kava foods must carry or be accompanied by “Use in moderation”.
- They must also carry or be accompanied by “May cause drowsiness”.
- The permitted kava foods must not contain substances used as food additives or processing aids.

Food Kava and Therapeutic Kava Are Different Regulatory Pathways
How the product is formulated, presented and promoted matters. A traditional food product should not automatically be treated as though it were the same thing as a kava-containing medicine.
Kava Supplied as Food
Food kava is principally governed by the Australian food standard together with applicable import, biosecurity and state or territory food-law requirements.

Important jurisdiction exception
Northern Territory Kava Rules Are Different
The Northern Territory should not be treated as just another Australian delivery destination. The Office of Drug Control specifically states that its incoming-passenger personal-use exemption does not apply there.
The Northern Territory's Kava Management Act 1998 remains in force and regulates or prohibits conduct involving kava, including possession and supply outside authorised pathways.
If your travel, possession, transport or supply involves the Northern Territory, check the current NT legislation and relevant government guidance before acting.
What this means for buyers
Is It Legal to Buy Kava Online in Australia?
In most Australian jurisdictions, compliant domestic buying pathways exist. The key distinction is whether you are buying stock already supplied through an Australian pathway or personally attempting to import kava from overseas.
Australian Online Supplier
When an Australian business is supplying stock already in Australia, the commercial importer and food business carry the relevant import and food compliance responsibilities. Buyers should still check seller identity, product labelling and destination restrictions.

Legality does not equal suitability
Legal Kava Still Requires Safety Consideration
Healthdirect Australia
Whether a kava product can lawfully be supplied is separate from whether it is appropriate for a particular person.
Healthdirect states that there is no safe level of kava use, that kava may cause drowsiness and that combining kava with alcohol or other drugs can be unpredictable and dangerous. People taking medicines should discuss kava with their doctor.
